If an individual has failed to properly plan in the event of their
disability, and they become incapacitated, the only viable solution
may be a guardianship or
conservatorship.
A guardian is a person appointed by the probate court to make
personal and financial decisions for the ward, either due to
age (minors), incapacity or mental illness. A guardian has custody
of the person of the ward and can make all decisions concerning
the ward’s well being, including medical treatment and
admittance to a long term care facility. |
